You can still go outside of the nation for short periods. What counts is that you have spent a total of 730 days in Canada since obtaining permanent residence in any five years.
Is there any way to count time spent outside of Canada towards your 730 days?
The government’s 730-day rule has certain exceptions. Time spent outside of the nation might occasionally be counted toward your 730 days.
The following are two instances in which your time spent outside of Canada may be used to satisfy the residence requirement:
- You are employed full-time outside of Canada by a Canadian company or by the federal, provincial, or territorial governments of Canada.
- You are the spouse, common-law partner, or dependent child of a Canadian citizen or permanent resident who works full-time for a Canadian company or the Canadian government.
Each day you spend outside of Canada will be counted as if you were physically present in Canada in both situations.
To prove you’ve satisfied the 730-day requirement, keep a thorough record of your excursions outside the nation (even day trips to the United States).
Other ways to lose your status as a permanent residence
Even if you have been awarded permanent resident status by the government, you may lose it under certain circumstances. If you have not been in Canada for at least 730 days in the past five years, the government has the authority to remove your status. You can also lose your status if you do the following:
- Apply to become a citizen of Canada.
- Give up (or “renounce”) your status as a permanent resident.
- Become ineligible to Canada due to a criminal conviction, financial, security, or medical grounds, or having a family member who is inadmissible.
Don’t be concerned if you lose your permanent residence status. You have 60 days from the time you find out you’ve lost it to appeal the verdict. By filing an appeal, immigration authorities will be able to reconsider their judgment. Before making a final decision, they may consider humanitarian and compassionate factors.
Demonstrating that you have completed the 730-day minimum
To maintain your permanent resident status, you must demonstrate that you satisfy the residency requirement. As a result, it’s critical that you keep a detailed record of your visits outside of Canada.
Permanent residents in Canada are encouraged to keep a travel diary in which they can record any journeys they have taken outside of the country, including same-day crossings over the border.
The date you left Canada, the date you returned to Canada, the destination, and the cause for your trip should all be included in this travel log. Although you will never be required to show this notebook to an immigration official, it is a useful tool for keeping track of any time spent outside the country (and possibly any time that does not count towards your 730-day residency requirement).
